<p>Budgeting and bankruptcy are the two most important parts of personal finance. If you fail to follow the previous one, you may have to opt for the latter. In that case, it is not only the debt amount that is going to go high, you will also end up hurting your credit. Budgeting helps you to determine your total income and your expenditures and to evaluate your necessities. So, budgeting is going to help you remain <a href="http://www.ovlg.com/debt-free.html">debt free</a>.</p>
<p><strong>Budgeting and saving money</strong></p>
<p><strong></strong>You may ask why you should budget if you can manage to pay all of your bills on time. Budgeting helps you to save money and so the things that you will be required to do are:</p>
<p>1. Practice frugal budgeting – You can practice frugal budgeting so as to save more than what you can actually do through a simple budgeting. Budgeting helps you save money as you are able to realize the exact needs and requirements. So, it becomes possible for you to utilize your money in the right direction.</p>
<p>2. Maintain emergency fund – You will be required to maintain an emergency fund so that you do not disrupt your budget. When an emergency situation is going to arise, you will end up expending more money than you can usually do.</p>
<p>3. Lower the expenditures – You will have to lower the expenditures based on your budget. Budget helps you to know the exact list of expenditures and so you are easily bale to realize which the ones that you actually require are. This helps you to cut down on your expenditures and save money.</p>
<p>4. Put in the money into retirement fund – Put the money that you are able to save through budgeting into the retirement fund. This is going to help you stay away from debt as much as possible and thus maintain a debt free life.</p>
<p>5. Remember to include variable expense in budgeting – While budgeting, it is not only the fixed expenses that you will be required to include. It is equally important for you to include the variable expenses too within your budget list. Otherwise, you will only end up making gross financial mistakes.</p>
<p>6. Make wise payments – While making the debt payments, remember to make wise payments. Like, if you are making payments on credit cards with high interest rates, you can consolidate these. This is important because, consolidation helps you save money as the interest rate on the consolidated debt lowers. Similarly, in case of the mortgage, you can refinance it to save money on the mortgage payments. Thus, you will be able to save money through this and contribute towards the savings accounts.</p>
<p>7. Maintain the utility bill payments – Just as it is important for you to maintain the debt payments, it is equally important for you to maintain the utility bill payments. This is important because, if you fail to maintain the utility bill payments, these can go into collections. In that case, the debt amount is going to increase and this again is going to have an effect on your budgeting.</p>
<p>So, here are the things that you will be required to do in order to budget and maintain a debt free life. Another very important thing is that you can budget on your own. <ul>
<li>use threats of violence or harm,</li>
<li>publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies),</li>
<li>use obscene or profane language, or</li>
<li>repeatedly use the phone to annoy someone.</li>
</ul>
<p>Debt collectors may not lie (make a false claim) when they are trying to collect a debt. For example, they may not:</p>
<ul>
<li>falsely claim that they are attorneys or government representatives;</li>
<li>falsely claim that you have committed a crime;</li>
<li>falsely represent that they operate or work for a credit reporting company;</li>
<li>misrepresent the amount you owe;</li>
<li>indicate that papers they send you are legal forms if they aren’t; or</li>
<li>indicate that papers they send to you aren’t legal forms if they are.</li>
</ul>
<p>Debt collectors also are prohibited from saying that:</p>
<ul>
<li>you will be arrested if you don’t pay your debt;</li>
<li>they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or</li>
<li>legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action.</li>
</ul>
<p>Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:</p>
<ul>
<li>give false credit information about you to anyone, including a credit reporting company;</li>
<li>send you anything that looks like an official document from a court or government agency if it isn’t; or use a false company name.</li>
<li>try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;</li>
<li>deposit a post-dated check early;</li>
<li>take or threaten to take your property unless it can be done legally; or</li>
<li>contact you by postcard.</li>

<p>If you are sued and you dispute the claim go ahead and file a defense. If you the money and in a position to make a settlement offer that your creditor has decline to accept, go ahead and file a defense and make the offer. Let the judge decide.</p>

The judgment states the amount of money you owe, and allows the creditor or debt collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.</p>
<p>Wage garnishment happens when your employer is ordered to withhold 20-25% of your paycheck to pay your debts. Your wages usually can be garnished only as the result of a court order. Don’t ignore a “plaintiff Claim”. If you do, you lose the opportunity to fight a wage garnishment.</p>
